About Orange County Lemon Law

The California legislature enacted the state’s lemon law for vehicles to provide buyers with a legal path to a refund or a replacement vehicle if they discover that they have purchased a lemon with significant manufacturing defects. If the buyer can demonstrate that the vehicle is a lemon that has not been properly repaired despite multiple trips to the shop, the buyer can use the lemon law to force the manufacturer to provide a refund or a replacement vehicle.

The California Lemon Law, formally called the Song-Beverly Consumer Warranty Act, safeguards buyers or lessees by offering a remedy when a vehicle doesn’t meet the manufacturer’s warranty standards and can’t be fixed after several attempts, protecting consumers from getting stuck with subpar vehicles.

What Vehicles Qualify Under the CA Lemon Law?

  • New Vehicles: California’s lemon law protects most recently purchased cars, trucks, and SUVs intended for personal or household use on state roads and highways.
  • Pre-owned Vehicles: The lemon law also applies to used vehicles still covered by the original manufacturer’s warranty.
  • Leased Vehicles: Leased vehicles can qualify as lemons if they meet the specified legal requirements.

The lemon law also extends to vehicles previously deemed lemons and repurchased by the manufacturer, then refurbished and resold with a warranty. These vehicles must have an active manufacturer’s warranty during the initial repair attempt, weigh less than 10,000 pounds, and be part of an entity owning one to five vehicles registered in California.

While motorcycles aren’t included in California’s vehicle lemon law, they fall under the state’s consumer lemon laws if they’re still under warranty. RVs are covered under the vehicle lemon law for drivetrain, chassis, and frame issues, with cabin-related problems falling under consumer lemon laws.

When is a Vehicle Considered a Lemon in Orange County?

For your vehicle to be considered a lemon under California law it must have a material defect that keeps you from using it as intended, that makes the vehicle unsafe, or reduces its value. This means that the lemon law usually will not apply to minor defects that do not impact your ability to use the vehicle.

Some common material defects that are often covered under the lemon law include the following:

  • Engine malfunction or failure
  • Electrical system malfunctions
  • Transmission malfunctions
  • Brake problems
  • Defects in the chassis or frame
  • Steering system malfunctions
  • Design defects

If issues with a vehicle stem from actions taken after its delivery by the manufacturer, you cannot file a lemon law claim. For instance, if you’re in an accident and unable to have the car repaired correctly, it doesn’t qualify for a lemon law claim.

How California’s Lemon Law Works in Court

If you have purchased a vehicle that has substantial material defects and made reasonable attempts to get them repaired under warranty, you can ask the manufacturer for a refund or a replacement vehicle under the California lemon law. Should the manufacturer refuse to help, you can file a lawsuit to force it to give you a refund or replacement. While a lawsuit may sound expensive, California law provides that if you win a lemon law case the manufacturer must pay your attorney’s fees and court costs.

In an Orange County Lemon Law case, there’s a structured legal process that typically unfolds. Initially, the plaintiff, often the vehicle owner, needs to prove that the vehicle indeed has significant defects covered by the Lemon Law. This proof might include repair records and correspondence with the manufacturer or dealership. The court then assesses if these defects substantially impact the vehicle’s usability, value, or safety. Should the ruling favor the plaintiff, remedies like a refund or a replacement vehicle may be mandated. Moreover, California empowers the court to impose a civil penalty on a manufacturer who knowingly disregarded the lemon law, potentially amounting to double the damages.

Seeking legal guidance from a seasoned Lemon Law Attorney in Orange County who understands the nuances of the California Lemon Law can be immensely beneficial for consumers, ensuring they navigate the legal intricacies effectively and advocate for their rights.

What Our Clients Are Saying!

It is a long established fact that a reader will be distracted by the readable content of a page when looking at its layout.

Claire T. Los Angeles, CA

I bought a new Ford C-Max Energi in 2014. After 36k miles I needed a new transmission. Another attorney I know referred me to Jacob Kashani saying he was "excellent." I immediately contacted Jacob and he explained the Lemon Law process thoroughly. I rejected Ford's first offer of settlement because it wasn't a "buyback" under the Lemon Law Statute. Instead, I asked Jacob to go ahead and file a lawsuit against Ford. He had no problem doing as I requested and, after a few months, Ford did offer to buy back my car, pay off my loan and pay my attorney's fees. I am very pleased with Jacob's handling of my case and how quickly he resolved my case. I would recommend you call Jacob if you are having problems with a new or used vehicle still under the manufacturer's warranty. Don't wait or wonder if you have a case, call Jacob. Also, Jacob's assistant Lavisha is so helpful and pleasant to deal with!

Karla J. Chatsworth Lake Manor, CA

My car was just purchased back by the Manufacturer! I am so appreciative of Jacob's experience and thankful to get a redo on a car that just kept going into the shop. He has been very responsive and quick responding to my questions throughout the process. I have a new car that's not breaking, thanks to Jacob! I am so happy, thanks a million!!

Patrick D. Torrance, CA

I bought a Honda civic in 2016, and had problems with the A/C almost immediately. I brought it into Honda's repair shop numerous times, and each time, they would say that nothing was wrong with it. I finally decided to contact Jacob to see what could be done, and it was the best decision I could have made. Jacob was always quick to respond, whether it was through call, text, or email. He also broke everything down into layman's terms since I don't know much about cars or the lemon law process. Last and most importantly, he fought to get me the most out of my situation. In the end, Honda fixed my A/C problem AND they gave me a generous settlement (about 3x more than what I expected).

Navid P. Los Angeles, CA

My Mercedes kept having problems and had been in the service station several times. A few times I had to go get a rent-a car which made it hard to fit into my schedule going after work to pick it up and drop it off. After several times of having car problems I decided to call Jacob. Jacob was caring, understanding, extremely knowledgeable, and helped me get a settlement very quickly. He answered all my questions and was extremely helpful. He is the go to attorney if you find yourself in this type of situations. His assistants are also fantastic. Thank you.

Javier P. Los Angeles, CA

Jacob and his team are awesome, they keep in contact with me all the time, during this process until I get my check from Ford.
