About Orange County Lemon Law

The California legislature enacted the state’s lemon law for vehicles to provide buyers with a legal path to a refund or a replacement vehicle if they discover that they have purchased a lemon with significant manufacturing defects. If the buyer can demonstrate that the vehicle is a lemon that has not been properly repaired despite multiple trips to the shop, the buyer can use the lemon law to force the manufacturer to provide a refund or a replacement vehicle.

The lemon law applies to most new cars, trucks, and SUVs purchased for yourself, your family, or your household. It also applies to vehicle purchases by businesses that have fewer than five vehicles. If you purchased your vehicle used, you can still make a claim under the lemon law if the vehicle is still under the manufacturer’s warranty. Additionally, the lemon law provides protection to those who purchased vehicles previously identified as lemons and repurchased by the manufacturer but were repaired and resold with a warranty.

Before you can bring a case under the lemon law, you must give the manufacturer a reasonable opportunity to repair the vehicle under its warranty. The law does not state the number of times you must bring it to the repair shop before making a lemon law claim, but the courts have said the manufacturer must have at least two chances to make the necessary repairs.

Motorcycles are covered under California’s consumer lemon laws if they are still under warranty. RVs are covered under the lemon law for vehicles, but the cabin living area is covered under the consumer lemon law while it is still under warranty.
