About San Francisco’s Lemon Law

California’s lemon law for vehicles protects consumers who have purchased cars, trucks, and SUVs that suffer from significant manufacturing defects that they cannot get repaired under warranty. Essentially, the law provides that if a customer can show that the vehicle they have purchased is a lemon, the manufacturer must give them a refund or replacement vehicle.

However, before you can bring a case under the lemon law, you need to give the manufacturer a “reasonable” number of opportunities to repair the problem. The statute does not define how many trips to the shop constitute reasonable efforts, but California courts have found that it means you need to have tried to get the problem fixed at least twice.

The law covers vehicles you have purchased for use by yourself, your family, or your household. The law also covers vehicles owned by businesses with fewer than five vehicles. Additionally, the vehicle must have a gross weight of less than 10,000 pounds. The lemon law applies to used vehicles that are still under the manufacturer’s warranty. Finally, customers who have purchased vehicles that a manufacturer had previously repurchased by the manufacturer after they were identified as lemons can bring a lemon law case if the vehicle was repaired and sold to them with a warranty.

Motorcycles are covered under California’s lemon law, but as consumer goods that are under warranty. RVs are covered by the lemon law for vehicles, but problems with the cabin are only covered while the vehicle is still under warranty.

What Qualifies as a Lemon in San Francisco?

Not every vehicle that has mechanical problems qualifies as a lemon under California law. The law specifies that the vehicle must have a material defect that prevents you from using it as intended, makes it less safe to operate, or reduces its value. You must also provide the manufacturer with a reasonable opportunity to repair the defect under warranty.

Some common material defects that can qualify a vehicle as a lemon if the manufacturer can’t properly repair them include the following:

  • Engine malfunction or failure
  • Electrical system malfunctions
  • Transmission problems
  • Brake malfunctions
  • Defects in the chassis or frame
  • Steering problems
  • Design defects

The lemon law does not cover vehicles that were damaged due to actions taken by their owner, including misusing the vehicle, failing to perform proper maintenance, or making improper after-market modifications.

How San Francisco’s Lemon Law Works

Once you have given the manufacturer a reasonable opportunity to repair the defects to your vehicle, you can ask for a refund or a replacement under California’s lemon law. If the manufacturer refuses to do either, you can bring a court case against the manufacturer to force it to take action. If your case is successful, the manufacturer is required to pay your legal fees and court costs. That means that you can bring a lemon law case without spending any of your own money.

Additionally, California will allow a judge to impose civil penalties on a manufacturer that failed to comply with the lemon law. The penalty amount can be up to twice your actual damages.
